This Acceptable Use Policy (“AUP”) governs the conduct of all users accessing the KEYZ Commercial website (https://keyzcre.com) and its associated digital services. By using our site, you agree to these standards, which ensure a secure and transparent environment for commercial real estate transactions.
1. Prohibited Commercial Use & Data Integrity
The data provided on keyzcre.com—including property listings, square footage, cap rates, and market reports—is the proprietary property of KEYZ Commercial.
- No Scraping or AI Harvesting: You are strictly prohibited from using automated tools, “bots,” “spiders,” or AI-driven “scrapers” to harvest our listing data, agent contact info, or market analytics.
- No Unauthorized Aggregation: You may not “mirror,” frame, or redistribute our listings on any third-party commercial platform without our express written consent.
- Data Accuracy: You agree not to submit fraudulent information through our contact forms or misrepresent your financial capacity to close a transaction.
2. Digital Transparency & “Truth in Marketing” (AB 723)
In compliance with California law effective January 1, 2026:
- AI & Altered Images: Users who upload content to our collaborative platforms must clearly disclose if any property image has been digitally altered or generated by AI to materially change the property’s appearance.
- Prohibited Alterations: You may not use our platform to transmit images that remove permanent structures, alter neighboring views, or otherwise mislead stakeholders about the physical condition of a property.
3. System Security & “Deal Room” Access
Access to our secure Property Deal Rooms and Offering Memorandums (OMs) is a privilege granted to verified investors and brokers. You agree not to:
- Credential Sharing: Share your login credentials or provide unauthorized third parties with access to confidential deal documents.
- Vulnerability Testing: Attempt to probe, scan, or test the vulnerability of our systems or breach any authentication measures.
- Malicious Software: Distribute viruses, malware, or any code designed to disrupt the functionality of our real estate platform.
4. Professional Conduct & Fair Housing
As a California-licensed brokerage, we enforce a zero-tolerance policy for discriminatory or illegal behavior.
- Fair Housing Compliance: You may not use our website to engage in any activity that violates the California Fair Employment and Housing Act (FEHA).
- Anti-Spam: You are prohibited from using agent email addresses or phone numbers found on this site for mass marketing, unsolicited “cold calling,” or any communication unrelated to a specific real estate inquiry.
5. California Privacy Standards (2026)
In accordance with the CPRA and the DELETE Act:
- GPC Compliance: You agree not to attempt to bypass any Global Privacy Control (GPC) signals or “Your Privacy Choices” settings implemented on our site.
- No Identity Harvesting: You may not collect personal information about other users or our staff for the purpose of building marketing lists.
6. Enforcement & Termination
KEYZ Commercial reserves the right to:
- Monitor: Monitor site traffic to identify “scraping” or suspicious bot activity.
- Terminate Access: Terminate access to secure deal rooms immediately, without notice, for any breach of this AUP.
- Report: Report fraudulent activity or unauthorized data access to the California Department of Real Estate (DRE) or local law enforcement.
